Terms & Conditions
Last Updated: 10/18/2026
Welcome to Dronerdy (“Company”, “we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your use of our website, dronerdy.com (the “Site”), and the aerial photography, videography, mapping, and related drone services (the “Services”) provided to you (“Client” or “you”).
By accessing our Site or booking our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Site or Services.
1. Regulatory Compliance & Flight Safety
- FAA Regulations: All operations are conducted in strict compliance with the Federal Aviation Administration (FAA) Part 107 regulations (or relevant local civil aviation authorities).
- Pilot in Command (PIC) Authority: The designated remote pilot retains final operational authority over all flight decisions. If the pilot determines that flight conditions are unsafe, illegal, or violate airspace restrictions, the pilot has the unilateral right to delay, reschedule, or cancel the flight.
- Airspace & Authorizations: Flights near airports or in controlled airspace may require prior authorization (e.g., LAANC or FAA waivers). While we endeavor to obtain all necessary clearances, service delivery depends on regulatory approval.
2. Weather & Rescheduling Policy
- Drone operations are highly weather-dependent. Flights cannot safely or legally occur during high winds, heavy rain, snow, dense fog, or other adverse conditions.
- If a flight must be postponed due to inclement weather, airspace restrictions, or safety concerns, we will notify you as soon as practicable and reschedule for the next mutually agreeable date at no additional rescheduling fee.
3. Site Access, Permissions & Safety
- Property Access: The Client is solely responsible for obtaining all necessary permissions, access rights, and legal authorizations to film at the requested location, including permissions from property owners, venue managers, and local authorities.
- Non-Interference: The Client and their guests/associates must maintain a safe distance from operating drones and must not distract the pilot during take-off, flight, or landing procedures.
4. Bookings, Payments & Cancellations
- Quotes & Estimates: Written quotes are valid for 30 days from the date issued, unless otherwise stated.
- Retainer / Deposit: A non-refundable deposit of 50% is required at the time of booking to reserve your flight date and time.
- Payment Terms: The remaining balance is due upon delivery of the final deliverables. We reserve the right to withhold deliverables until full payment is received.
- Client Cancellations:
- Cancellations made more than 48 hours prior to the scheduled shoot will forfeit only the initial deposit.
- Cancellations made within 24 may be subject to a fee of 50% of the total project value.
- Same-day cancellations or client no-shows are billed at 100% of the total contract amount.
5. Intellectual Property & Licensing
- Copyright Ownership: Unless explicitly agreed upon in a written “Work-for-Hire” contract, Dronerdy retains full copyright and ownership of all raw and edited footage, photographs, and digital assets.
- Client License: Upon receipt of full payment, the Client is granted a non-exclusive license to use, reproduce, and display the delivered media for the agreed-upon purpose (e.g., real estate listing, marketing campaign, internal review).
- Portfolio Usage: We reserve the right to display raw or edited footage, photographs, and behind-the-scenes material on our website, social media, and marketing portfolios, unless a formal Non-Disclosure Agreement (NDA) has been executed beforehand.
6. Deliverables & Revisions
- Delivery timelines will be outlined in the project agreement. Delivery formats typically include digital download links.
- Any requested artistic or editing revisions beyond the agreed project scope will be billed at our standard hourly rate of $75/hr.
7. Limitation of Liability & Indemnification
- Liability Cap: To the fullest extent permitted by law, our total liability for any claim arising out of our Services or these Terms shall not exceed the total amount paid by the Client for the specific project in question.
- Indirect Damages: We are not liable for indirect, incidental, or consequential damages, including loss of business, profits, or data.
- Indemnification: The Client agrees to indemnify and hold harmless Dronerdy, its officers, employees, and contractors from any claims, damages, liabilities, or expenses arising from the Client’s failure to secure proper property permissions, violations of privacy, or misuse of delivered media.
8. Privacy & Personal Information
- We take reasonable measures to respect the privacy of individuals near flight paths. Flights will not target or focus on individuals without consent.
9. Governing Law & Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions.
- Any disputes arising from these Terms or our Services shall be resolved through good-faith negotiation, and if necessary, binding arbitration or small claims court in Laporte County, Indiana.
